1. GENERAL CONSIDERATIONS

1.1 Purpose

These General Terms and Conditions of Sale (“GTC”) apply when you (“Customer”) place an order on the website www.cartellshop.ch , its associated pages (“Site”), or in the Cartell physical store in Switzerland. The sales contract is concluded between you and Cartell (“Cartell”), a company registered under number CHE-215.1178.961. Cartell’s full contact details are available on its website.

The current T&Cs are those published on the Site at the time of the order. They apply only to purchases made via the Site or in-store. Any modification to the T&Cs or the addition of specific conditions requires the written consent of Cartell. Cartell reserves the right to modify the T&Cs at any time.

1.2 Age restrictions and refusal of order

To order, you must be at least 18 years old, as Swiss law prohibits minors from purchasing on credit. Cartell may reject or modify an order, particularly if the information provided is incorrect or if your credit history is deemed insufficient.

1.3 Availability of products and accuracy of information

Products are offered subject to availability. Cartell assumes no liability for typographical errors, inaccurate images, incorrect descriptions, or price variations (e.g., due to suppliers or currency fluctuations). Information may be corrected or updated at any time.

If an incorrect price is displayed for a product ordered, Cartell will inform you and await your approval of the corrected price before shipping your order. Illustrations on the Site are provided for informational purposes only and do not guarantee the exact appearance of the products. Cartell is not responsible for information provided by third parties and published on its Site.

1.4 Intellectual Property

The Site, the store, and their contents are the property of Cartell or its partners and are protected by intellectual property laws. Any reproduction or use of trademarks, trade names, images, graphics, layouts, or other content is prohibited without the written permission of Cartell.

2. CONTRACT AND ORDER

2.1 Acceptance of the T&Cs

Before making any purchase on the Site or in store, you must accept the General Terms and Conditions of Sale (GTC). By accepting them, you confirm that you have read, understood, and fully complied with them. You also agree to Cartell's Privacy Policy, including the use of your personal data and cookies.

2.2 Formation of the purchase contract and ownership of the items

The purchase contract is formed:

In store : at the time of payment.

By phone or message : upon acceptance of the order by Cartell.

On the Site : when your order is confirmed by email. We recommend that you keep this email, as it will be useful for any future exchanges with Cartell.

You can cancel an order as long as it has not been confirmed by Cartell. In the event of cancellation, any payment already made will be refunded.

Items remain the property of Cartell until full payment has been received.

3. CLAIMS FOR INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS

3.1 Responsibility for works marketed

Cartell acts as an intermediary for the sale of works created by independent artists (the "Licensors"). The Licensors guarantee that their works comply with applicable law and do not violate any intellectual property rights or other third-party rights.
Cartell declines all responsibility in the event of a dispute concerning a violation of rights by a work sold on its platform or in stores.

3.2 Procedure in the event of a complaint

If you believe that a work sold infringes your rights (for example, copyright or trademark), please report it to Cartell at: info@cartellstudio.ch .
Your claim must include:

Your full contact details (name, address, telephone, email).

A precise description of the work in question.

Proof of your rights to the work (proof of ownership or registration).

Any other useful information to support your claim.

3.3 Complaints management

Upon receipt of your complaint, Cartell:

Will analyze it within a reasonable time.

Will temporarily suspend the sale of the relevant work if necessary.

Will inform the artist and collect his explanations.

Cartell will act as an intermediary between the parties, but declines all responsibility for any disputes or damages related to the works. Any legal action must be taken directly against the artist concerned.

3.4 Limitation of liability

Cartell cannot guarantee that the works sold are free of infringement. By accepting these terms, you acknowledge that any dispute regarding intellectual property rights infringement must be resolved directly with the artist or the Licensor.

4. PRICE, FEES AND PAYMENT

4.1 Price

All prices for Cartell items are displayed in Swiss francs, including VAT and other statutory taxes, but excluding delivery charges, unless otherwise stated. In-store prices may differ from those displayed on the Site. The prices and conditions in effect on the date of the order apply.

4.2 Payment

Payment must be made using the options available on www.cartellshop.ch . The accepted payment methods are indicated there.

Cartell reserves the right to charge the order amount unless another payment method has been previously selected. If a payment method fails or is not offered for any reason, it is your responsibility to change your choice during the ordering process.

In case of reimbursement:

For online purchases, Cartell uses the same payment method as the one initially used.

For in-store purchases, reimbursement is made exclusively in the form of a gift card.

5. PROMOTIONS AND OFFERS

Cartell may organize promotions on its site, offering more advantageous purchasing conditions than those provided for in these T&Cs (for example, payment facilities or extension of the right of withdrawal).

These promotional conditions apply only to:

For the duration of the promotional campaign.

To the products selected by Cartell as part of this campaign.

Cartell reserves the right to terminate promotions at any time. In the event of a campaign being terminated or ended, these Terms and Conditions will apply.

Promotional offers are valid for the duration of their offer or while stocks last.

6. GIFT CARD

Cartell gift cards are valid for one (1) year from the date of issue. They can be used on the cartellshop.ch website or in-store.

After the expiration date, the gift card:

Can no longer be used as a means of payment.

Cannot be reactivated.

Does not give rise to any reimbursement of the remaining value.

The gift card is a valuable document that should be kept safe. It cannot be exchanged for cash and will not be replaced if lost or stolen.

7. DELIVERY AND TRANSPORT

7.1 Delivery area

Cartell only delivers to Switzerland and the Principality of Liechtenstein.

7.2 Delivery times

Our products are packaged and shipped at the beginning of each week following your order.

Shipping time: between 1 and 2 working days.

If you have not received your order within this time frame, contact Cartell within 30 business days of placing your order. Shipping costs, payable by the customer, vary based on weight and are automatically calculated and displayed during the ordering process. Shipments generally begin at the beginning of the week following the conclusion of the contract, unless otherwise agreed.

7.3 Delivery Date

The estimated delivery date is communicated in the order confirmation, on the product page, or at the time of purchase. In the event of a delay exceeding 30 business days and not attributable to the customer, the customer may cancel their order.

Significant delays are reported whenever possible. However, delays or overruns of the scheduled date do not entitle you to terminate the contract or receive a full or partial refund.

7.4 Collection of parcels and “Click & Collect” service

Cartell offers a “Click & Collect” service allowing customers to order online and collect their items directly from the Cartell store. Store addresses and opening hours are available at www.cartellshop.ch .

A notification will be sent via email or SMS to indicate that the order is ready for pickup. Upon pickup, a valid ID and the order number must be presented. Customers must collect their order within the time specified in the notification.

In the event of non-collection within this period, Cartell reserves the right to apply a processing fee of CHF 40 , as well as new delivery costs if the order has to be shipped elsewhere.

7.5 Verification of the goods

Upon receipt of items, whether delivered or via Click & Collect, customers must immediately check that their order is complete and in good condition. Any anomalies or defects detected subsequently must be reported to Cartell as soon as they are discovered, so that corrective action can be taken quickly.

7.6 Liability upon delivery

Cartell guarantees proper delivery to the address designated by the customer or to the selected collection point. Once delivery is confirmed by the carrier or upon collection in store, ownership and risk (loss, theft, or damage) are transferred to the customer.

Customers can report any delivery issues (e.g. non-receipt, damaged item) within 14 days of the confirmed delivery or collection date . Cartell is committed to handling these claims in accordance with the law, with the possibility of replacement or refund if the order has not been delivered or received in a compliant condition.

8. RIGHT OF RETURN AND WITHDRAWAL

8.1 Right of withdrawal

The right of withdrawal only applies if the product is damaged.

Online Purchase: As products are fragile and cannot be repackaged, we do not accept returns from customers in the event of a “change of mind”. In the event of a damaged product upon delivery, please send a clear statement (by email or post) stating your decision, including your contact details, the order number, the product concerned and any other relevant information, e.g. photos. 8.2 Returns and conditions

For in-store purchases : Items must be returned in their original condition , without dirt, damage or modifications, and in their original packaging.

Returns of items in perfect condition will be fully refunded in the form of a gift card, only if the purchase was made in store.

If a returned product shows obvious signs of use or is damaged, Cartell reserves the right to refuse a refund.

8.3 Exclusions

Items purchased on sale or specially customized are not eligible for return or refund.

Incomplete, modified, damaged or soiled products are excluded from the right of return.

8.4 Practical advice

Proof of purchase: Make sure you keep your receipt or invoice.

Products in perfect condition: Unused products in perfect condition, returned with their original packaging and which have not been opened, will be fully refunded in the form of a gift card in store.

9. WARRANTY AND COMPLAINTS

9.1 Legal guarantee

Items purchased from Cartell do not come with a legal warranty.

9.2 Complaints

If you find a defect, you must report the problem within 14 days of purchasing the item , providing a clear description, photos, and the order number. Complaints should be sent to:

9.3 Coverage of shipping costs

Cartell will cover the return shipping costs for defective products when the claim has been approved.

9.4 Refund or Replacement

After receipt and inspection of the defective product, Cartell undertakes to:

Replace the product with an identical or equivalent item,

Refund the purchase price if repair or replacement is not possible.

Cartell will endeavor to refund you within 14 days of receiving your claim , but this period may be extended depending on the nature of the products. Cartell reserves the right to reject a claim request if the product concerned does not have a defect under current consumer protection regulations.

10. LINKS

Cartell may provide links to other external sites on its website that are beyond its control. While Cartell strives to provide links to sites that comply with security and privacy regulations, it is not responsible for the security or protection of any personal information you provide on these third-party sites. We recommend that you review the privacy policies of these sites before using them.

11. FORCE MAJEURE

Cartell shall not be liable for delivery delays or any failure to perform the contract in the event of force majeure. Force majeure includes, but is not limited to: strikes, natural disasters, fires, acts of war, network outages, transportation problems, or any uncontrollable event. In the event of force majeure, Cartell will inform you of the impact on delivery times. If the force majeure situation persists for more than two months, you and Cartell shall have the right to cancel the purchase with immediate effect.

12. MODIFICATIONS TO THE CONDITIONS

Cartell reserves the right to modify these general terms and conditions of sale at any time. Any modifications will be published on the Cartell sales website and will be applicable upon acceptance of the new conditions by the customer when placing a new order or visiting the website. We advise you to regularly consult the general terms and conditions to stay informed of any possible changes.

13. NULLITY

If one or more provisions of these Terms and Conditions of Sale are deemed invalid or unenforceable by a competent authority (court or other judicial authority), the other provisions will remain valid and applicable. Invalid or unenforceable provisions will be reviewed by legal advisors in order to comply with applicable laws.

14. APPLICABLE LAW AND DISPUTES

14.1 Dispute Resolution

Any dispute will initially be resolved amicably by contacting Cartell directly. If an agreement is not reached, the dispute will be submitted to the competent courts.

14.2 Law and jurisdiction

These terms are governed by Swiss law. In the event of a dispute, the competent court will be located in Lausanne, Switzerland.
